Litigation
We defend public and private employers of all sizes and in various industries as well as workers’ compensation insurance carriers against injury by accident and occupational disease claims before the Virginia Workers’ Compensation Commission. We have experience trying workers’ compensation cases before Deputy Commissioners in all parts of Virginia. We also routinely handle appeals to the full Commission and the Court of Appeals.
Advice & Ancillary Services
In addition to the litigation of claims, we advise our clients with respect to medical treatment issues, return-to-work efforts, and settlement negotiations. Our attorneys also counsel clients on the interplay between workers’ compensation law and other statutes and areas of law, including Social Security benefits, Medicare, FMLA and other federal labor laws. We can also provide expertise on planning for the purposes of mitigating and preventing claims and common problems that may arise from them.
Subrogation
Frith, Anderson & Peake routinely handles claims that the insurer or employer can assert against recoveries an injured employee receives from a third party for injuries that were already compensated through Workers’ Compensation claims. We recoup monies paid through Workers’ Compensation insurance by entering in or initiating litigation and by negotiating settlement of Workers’ Compensation liens.
